SwyftPAY provides credit card processing, point-of-sale systems, merchant services, and related payment solutions. Our services are subject to applicable laws, regulations, and card network rules.
2. Eligibility
To use our services, you must be at least 18 years old and have the legal authority to enter into a binding agreement. If you are using our services on behalf of a business, you represent that you have the authority to bind that business to these Terms.
3. Account Responsibilities
When using our services, you agree to:

- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
4. Payment Processing
All payment processing services are subject to the terms of your merchant services agreement. Transaction processing times, fees, and settlement schedules are determined by your specific agreement and the applicable payment networks.
You acknowledge that payment processing involves third parties, including card networks (Visa, MasterCard, American Express, Discover) and financial institutions, each with their own terms and conditions.
5. Fees and Pricing
Service fees, equipment costs, and processing rates will be outlined in your individual merchant services agreement. We reserve the right to modify our pricing with advance written notice. Any changes will not affect existing contractual obligations unless otherwise agreed.
6. Equipment and Software
Clover® POS systems and related equipment and software are provided subject to the manufacturer's terms of use and warranty. SwyftPAY acts as an authorized dealer and is not the manufacturer of these products.
7. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of SwyftPAY or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Prohibited Uses
You agree not to use our website or services to:
- Violate any applicable laws or regulations
- Process fraudulent or unauthorized transactions
- Transmit malware, viruses, or other harmful code
- Interfere with the operation of our website or services
- Impersonate any person or entity

9. Limitation of Liability
To the fullest extent permitted by law, SwyftPAY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

We may suspend or terminate your access to our services at any time for any reason, including violation of these Terms. Upon termination, your right to use our services will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Hennepin County, Minnesota.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
